1. Definitions

1.1 HostMyBot: The company providing free Discord bot hosting services.
1.2 User: Any individual or entity who registers for and uses the Service.
1.3 Service: The free provision of server and network resources for hosting Discord bots.
1.4 Agreement: The contract between HostMyBot and the User governing use of the Service.

2. Scope of Application

These Terms of Service apply to all use of HostMyBot’s free Discord bot hosting Service. Any deviation must be agreed in writing.

3. Service Provision

3.1 HostMyBot will provide the Service as described on the website and in official communications.
3.2 The Service includes:

• Access to server resources
• Network and internet connectivity
• Basic uptime monitoring (target: 99.9%)

3.3 The User is solely responsible for installing, configuring, maintaining, and updating their own Discord bot software.

4. User Responsibilities

4.1 The User guarantees that hosted bots comply with all applicable laws, third-party rights, and these Terms (see Section 5).
4.2 The User must provide accurate contact information and promptly notify HostMyBot of any changes.
4.3 The User is responsible for backing up all data; HostMyBot does not guarantee data retention.

5. Prohibited Use

The User shall not use the Service to:

• Store or distribute illegal, offensive, or copyrighted material without permission.
• Conduct DDoS attacks, spamming, phishing, or other cybercriminal activities.
• Host malware, ransomware, or any malicious software.

Violation may result in immediate suspension or termination of the Service without prior notice.

6. Fees

6.1 The Service is provided free of charge.
6.2 HostMyBot reserves the right to introduce paid plans or limitations in the future, with 30 days’ advance notice to Users.

7. Term and Termination

7.1 This Agreement becomes effective upon registration and continues indefinitely.
7.2 The User may terminate the Service at any time by sending a request via email or Discord.
7.3 HostMyBot may terminate the Agreement immediately if the User seriously breaches these Terms.
7.4 One (1) month after a server has expired, HostMyBot reserves the right to permanently delete the server and all associated data without further notice, in order to free resources for other Users.

8. Liability

8.1 HostMyBot’s liability is limited to direct damages caused by deliberate intent or gross negligence, up to a maximum of €100.
8.2 HostMyBot is not liable for indirect damages, loss of profits, or data loss.

9. Privacy and Data Protection

9.1 HostMyBot processes personal data in accordance with applicable GDPR regulations.
9.2 HostMyBot is the data controller for user account information; the User is the data controller for all bot-related data.

10. Changes to the Terms

HostMyBot may amend these Terms. Changes will be communicated at least 30 days in advance via Discord or email.

11. Governing Law and Dispute Resolution

11.1 These Terms are governed by Dutch law.
11.2 Disputes shall be submitted to the competent court in Amsterdam, unless parties agree otherwise.
